TERMS & CONDITIONS OF SALE

  • VEHICLE AUCTION
1. GENERAL INFORMATION:
National Auction Company, on behalf of Court Appointed Chapter 7 Bankruptcy Trustees, will conduct an auction of four vehicles described in each Information Sheet.
2. AUCTION DATE:
  • This auction will be conducted as a Timed Bid Online Auction. Bids will be received at www.natlauction.com and conducted on the Proxibid.com auction platform.
  • Registration for the auction will be through Proxibid.com, and those who plan to participate are required to register with Proxibid.
  • The auction will open on December 30, 2025, at 3:00 P.M. and will close on January 10, 2026, at 11:00 A.M.
3. REPORTING OF BIDS:
  • All High Bid Prices will be reported to the Court Appointed Bankruptcy Trustees at the close of the timed bid auction. Bids received after published closing times will not be accepted except those that fall under the conditions of Extensions of Bid described in the paragraph that follows.
  • In the event a bid or bids are made during the last two minutes of an auction, the ending time for the auction will be extended for an additional two minutes. Extensions will continue until no further bids are received within the last two minutes of the auction. National Auction Company and the Court Appointed Trustee have no control over this process.
4. FORM OF AUCTION:
  • The vehicles described are being offered, subject to Confirmation of Top Bid Prices by Court Appointed Bankruptcy Trustees.
  • In the event any top bid price is not confirmed by the Court Appointed Bankruptcy Trustee, the vehicle may be withdrawn from the auction and offered at another time at the discretion of the Court Appointed Bankruptcy Trustee.
  • It is expected that top bid prices will be confirmed and Top Bidders will be notified their bid has been accepted within 48 hours from the time the auction closes.
  • The Bankruptcy Trustees and Auctioneer reserve the right to establish a minimum amount for the opening bid.
5. PLACE:
  • The Auction will be conducted by National Auction Company, and information about the auction can be found at www.natlauction.com. Proxibid will be used as the auction platform for this auction event.
6. INSPECTION OF VEHICLE:
  • The vehicles being offered in this auction can be previewed on January 9, 2026, during the hours of 10:00 AM and 4:00 PM by appointment only. Please contact George Richards to schedule (954-658-5033).
  • These vehicles are being stored at National Auction Company, 1900 SW 100 Avenue, Miramar, Florida 33025.
  • Potential bidders/purchasers will not be permitted to drive the vehicle prior to the auction.
  • All vehicles are being offered and sold in As-Is Condition.
  • Information provided on the website, including descriptions and photographs, is believed to be correct but is not guaranteed without guarantee or warranty, either expressed or implied.
7. CONDITIONS OF SALE AND DELIVERY:
  • The Court Appointed Bankruptcy Trustees are offering for sale the vehicles described, subject to the Confirmation of the Top Bid prices at the close of the auction.
  • Any supplemental announcements that may become necessary will be sent as emails through the website and distributed to all registered bidders.
  • Despite efforts to avoid withdrawal of any item from the auction after being published and/or advertised, there could be circumstances when such action is necessary. The Court Appointed Bankruptcy Trustees reserve the right to remove any item from the auction, cancel or postpone the event, and reserve the right to accept or reject any/all bids.
  • Once the top bid price has been received and communicated to the Court Appointed Bankruptcy Trustees, and confirmed, all sales are final and will not be subject to any refunds or exchanges.
  • All successful bidders agree to comply with all terms and provisions as listed above.
8. BUYER’S PREMIUM:
  • A 10% Buyer’s Premium will be added to all top bid prices and included in the final purchase price.
9. NOTIFICATION TO TOP BIDDERS:
  • High Bidders will be notified that their bid has been accepted by National Auction Company through the email address supplied at the time of Bidder Registration.
10. PAYMENTS:
  • Payments will be accepted starting on January 12, 2026, by appointment between the hours of 10:00 A.M. and 3:00 P.M.
  • All payments must be made at the office of National Auction Company, 1900 SW 100 Avenue, Miramar, Florida 33025.
  • Payments can be made by Cash, Money Order, or Cashier’s Check. All checks should be made payable to National Auction Company, Auctioneer’s Escrow Account.
  • Purchasers paying with $10,000.00 cash or more will be required to provide information needed to comply with IRS Form 8300.
  • Payments can also be made via Bank-to-Bank Wire Transfer. Specific wire instructions will be provided upon request.
  • Credit Cards, Debit Cards, or payment formats such as Zelle WILL NOT BE ACCEPTED.
  • Payments made after January 14, 2026, may be subject to a surcharge of 10% of the purchase price.
11. MOTOR VEHICLE TITLE, KEYS & TRANSFER OF TITLE:
  • Certificates of Title are available for two of the vehicles being offered in this auction and will be provided to Purchasers at the time payment in full is made.
  • Certificates of Title will be ordered for the other two vehicles, and it is expected that they will take 30 days to receive them.
  • Keys to all vehicles are available and will be provided at the time of pick up.
  • Invoices and Bills of Sale will be in the name of the Purchaser only as registered for this auction with National Auction Company and Proxibid.
  • Purchasers are responsible for transferring the Certificate of Title into their name as listed on the Invoice and Bill of Sale. All registration fees, title transfer fees and sales tax will be paid directly to the Department of Motor Vehicles or a Licensed Auto Tag Agency. This transfer must take place within 30 days of the date stated on the Invoice and Bill of Sale.
  • All Certificates of Title will be closed and include the name of the Purchaser, their address, the date the vehicle was sold, and the purchase price.
12. SALES TAX:
  • Florida Sales Tax will be calculated on the full purchase price, that is, the top bid price plus a 10% Buyer’s Premium.
  • National Auction Company does not collect sales tax on titled motor vehicles, which must be paid at the time of title transfer.
  • Dealers who purchase for resale must provide a copy of their 2026 resale certificate to National Auction Company by e-mail to lori@natlauction.com. If this certificate is not provided, sales tax will be shown on the Invoice and Bill of Sale. Open titles will not be given to purchasers.
13. DEFAULT:
  • If a buyer fails to complete the sale under the conditions set forth or agreed to by Court Appointed Bankruptcy Trustees, any deposits and/or payments made will be forfeited, and the vehicle will remain the property of the Bankruptcy Estate.
  • If a Top Bidder fails to make payment in full after being notified their bid has been accepted, at the discretion of Court Appointed Bankruptcy Trustees and/or the Auctioneer, the bidder’s name may be subject to removal from the mailing list and may not be permitted to participate in future auctions. Failure to make the final payment may result in removal from future bidder registration (s) for other auctions conducted on the Proxibid platform.
14. REMOVAL/PICKUP:
  • Vehicles can be picked up starting January 12, 2026, but must be picked up no later than January 14, 2026.
  • Purchasers must schedule pickup on an appointment basis. Appointments should be made with George Richards of National Auction Company at (954-658-5033). Purchasers must provide a copy of a paid Invoice from National Auction Company with valid identification that includes a photograph.
  • Top Bidders/Purchasers using Towing or Transport Services must be present when their items are being removed.
  • Top Bidders (Purchasers) will be required to sign a receipt which shows delivery of purchased Vehicles.
15. REGISTRATION:
All bidders are required to register with National Auction Company on their website, www.natlauction.com. To participate in the auction, all bidders must register with Proxibid.com. Each Bidder will be assigned a Bidder’s Number, and that number will be recorded for each sale.
16. COLLUSION:
  • Collusion is any agreement among competitive bidders designed to mislead or stimulate other persons who are bidding in good faith.
  • Auctions are governed under the Sherman Act, enacted in 1890. The Sherman Act prohibits any agreement among competitors to fix prices, rig bids, or engage in other anti-competitive activity.
  • Violations of the Sherman Act may be considered to be a felony and punishable by fines established in the Act.
17. DIRECTIONS TO NATIONAL AUCTION COMPANY OFFICE:
From I-95 (Broward County)Exit at Pembroke Road and continue West to Palm Avenue. At the traffic light, make a U-Turn and continue east to SW 100 Avenue and turn right. Continue on SW 100 Avenue to the middle of the block. The office is located on the west side of SW 100 Avenue.From the Florida Turnpike (Broward County)Exit at Hollywood/Pines Boulevard (West). Continue to Palm Avenue and turn left at the traffic light. Continue southbound on Palm Avenue to Pembroke Road and turn left. Continue on SW 100 Avenue to the middle of the block.
