2. AUCTION DATE:
-
This auction will be a Timed On-Line Auction. Bids will be received at www.natlauction.com and conducted on Proxibid.com.
-
Registration for the auction will be through Proxibid.com, and bidders will be required to comply with terms established by Proxibid.com.
-
The auction is scheduled to open on Thursday, January 12, 2023, at 3:00 P.M. and end on Tuesday, January 17, 2023, with lots starting to close at 3:00 P.M. All stated times utilized for this auction are based on Eastern Standard Time.
-
The auction website will use staggered closing times, but all bids will end on January 17, 2023.
-
All top bid prices will be reported to The Board of County Commissioners, Broward County, Florida. Bids received after published closing times will not be accepted except those that fall under the conditions of Bid Extensions.
-
Bid Extensions: In the event a bid or bids are made during the last two minutes of an auction, the ending time for the auction will be extended for an additional two minutes. Extensions will continue until no further bids are received. This process is under the total control of Proxibid.
-
All Vehicles included in this Timed-Bid Auction are offered Subject to the Confirmation of The Broward County Board of County Commissioners. If top bid prices are not confirmed by Broward County personnel, items may be withdrawn and included in an auction to be conducted at a future time. It is expected all Top Bidders will be notified their bid has either been accepted or rejected no later than 48 hours from the time the auction closes.
-
The Auctioneer reserves the right to establish minimum opening bid prices and amounts for bid increases. In the event bidders do not comply with the minimum amounts stated, bids received that are less than those set forth will not be accepted.
3. AUCTION SITE:
-
The Auction will be conducted by the National Auction Company on Proxibid.com.
4. INSPECTION OF VEHICLES:
-
The Vehicles scheduled for inclusion in this auction are available for preview on an appointment-only basis. Prospective bidders who want to schedule an appointment should contact George Richards at National Auction Company at (954) 658-5033.
-
The Auctioneer and his staff have provided information pertaining to each item included in the auction. These descriptions indicate the current condition of the items included in the auction. Photographs and descriptions will be published on the Auctioneer’s website.
-
At the time information was gathered for this auction, an attempt was made to start each vehicle. Some vehicles could be started on their own, while others were jump-started. This information is included on the Auctioneer’s website and noted on the windshields. Videos are provided of the vehicles that could be started. This information is not guaranteed, and prospective bidders should rely upon their own judgment concerning the condition of each item.
-
No attempt was made to start the Transit Buses. Some of them were driven to the auction site while others were towed there. The Auctioneer and his staff do not have the ability to attempt to start the buses that are included in this event.
-
Please be advised because there is a video illustrating a vehicle could be started does not guarantee it will start and run at a later time. In addition, it does not guarantee any vehicle can be driven for long distances.
-
Auction materials indicate whether or not a vehicle can be started. In nearly every case, vehicles were jump-started and likely will need new batteries. Those that could not be started are designated by the letters N/R, meaning the vehicle does not start.
-
Some vehicles included in this auction will have to be towed. Purchasers/Bidders must make their own arrangements for towing.
-
Information is included regarding the operation of air-conditioning in vehicles. It should not be assumed air-conditioning will be operating when vehicles are picked up.
-
When these vehicles were started, if mechanical issues were observed, that information was included on the website. Bidders should not assume all mechanical issues were found. All of the vehicles and equipment are specifically being offered in As-Is condition without warranty of any kind.
-
While efforts have been made to accurately describe and illustrate the condition of each vehicle included in this auction, it is possible all defects were not observed and/or reported.
-
Information regarding odometer and/or hour meter readings might not be accurate even though efforts were made to confirm and provide correct information. In the event actual odometer and/or hour meter readings are different from those reported in auction information, the sale will not be invalidated as a result of differing information.
-
Specific questions or other information should be addressed to George Richards at (954) 658-5033. It is possible specific information requested may not be available.
5. COLLUSION:
-
Collusion is defined as an agreement among competitive bidders to raise, fix or otherwise maintain the price at which goods or services are sold.
-
Auctions are governed under the Sherman Act enacted in 1890. The Sherman Acts prohibits any agreement among competitors to fix prices, rig bids or engage in other anti-competitive activity.
-
Violations of the Sherman Act may be considered to be a felony and punishable by fines established in the Act.
-
Bidders planning to participate in this auction should be aware violations that come to the attention of National Auction Company will be reported to the Broward County Board of County Commissioners for action they determine to be appropriate.
