Auctioneer's Note: This report is provided for general information and might not include every item that is to be included in the auction. There could also be other items that will not be included in the auction because it is determined they are leased and not the property of the Debtor. It is the intent of the Trustee to sell every asset that is part of this estate. Lot numbers have not yet been assigned.

TERMS & CONDITIONS OF SALE

1. BIDDER REGISTRATION:
The auction is open to the public and all bidders are required to register with the auctioneer to receive a bidder's card. Bidder Registration will begin at 8:00 A.M. on Auction Day.

2. PREVIEWS:
Assets scheduled for inclusion in this auction will be available for preview Friday, March 24th from 1:00 P.M. to 5:00 P.M. & two hours prior to the auction. All assets are offered and sold in As Is condition without warranty of any kind. Bidders are encouraged to preview the items included in this auction.

3. PAYMENT & DEPOSITS:
Payment in full is expected at the conclusion of the auction by Cash, Cashier's Checks or Money Orders. Corporate checks will be accepted when accompanied by a current Bank Letter (made specifically for this auction and addressed to National Auction Company) guaranteeing payment and subject to verification at the time of Bidder's registration. Bidders who leave the auction site without paying in full are required to make a deposit in the minimum amount of 25% and advise auction staff when they are returning with any balance due. If no deposit is made, the Auctioneer reserves the right to resell any items purchased during the auction. Balances due must be paid on auction day no later than 5:00 P.M.

4. FLORIDA SALES TAX:
All sales are subject to the rules of the Florida Department of Revenue. The sales tax rate in Broward County is 6%. Florida dealers with resale numbers are asked to bring a certificate to the auction and present it at the of bidder registration.

5. FORM of AUCTION:
This auction is conducted By Order of Marc Barmat, Bankruptcy Trustee for Endless Jewelry North And South America, LLC and no other assets will be included in this event. All assets are offered for sale to the highest bidders. The Auctioneer reserves the right to offer the assets by the piece or in bulk.

6. BUYER'S PREMIUM:
A 10% Buyer's Premium will be added to all top bids and included in the total purchase price. Final invoices will reflect top bid prices and 10% Buyer's Premium.

7. METHOD OF SALE:
  • The method and order of sale will be at the auctioneer's discretion.
  • Recognition of bid increments will be at the discretion of the auctioneer. If items are offered and no bids are received, the auctioneer may remove them from the order of sale and offer them later during the auction or regroup them with other items.
  • The auctioneer reserves the right to add or delete any items from the auction if so directed by the Trustee.
8. OTHER TERMS OF SALE:
  • The terms and conditions of sale may be changed by announcement from the auction podium and take priority over previously printed materials or oral statements made.
  • Bids will only be accepted from bidders who have registered with the auctioneer. In the event of disputes between bidders or tie bids, the auctioneer's decision will be final.
  • The Auctioneer reserves the right to ask for additional deposits from any bidder during the course of the auction. Should an additional deposit be requested and not given, goods previously sold may be subject to resale at the option of the Auctioneer.
  • All information contained in the auction publication, newspaper ads, web site or furnished by staff members is believed to be correct but not guaranteed. Bidders must rely upon their own information, judgment and inspection of the assets offered. Any item counts are not guaranteed.
  • The auction will be electronically recorded and is the property of National Auction Company and Trustee.
  • Purchasers are not permitted to resell items purchased during the auction to third parties or reassign auction clerking tickets to other bidders.
9. REMOVAL OF PURCHASES:
All purchases must be removed from the premises as soon as possible after completion of the auction. Purchasers cannot be removed until the auction has been completed and full payment has been made. Purchasers will be given access to the auction site until 5:00 P.M. on auction day and on Monday, March 27th from 9:00 A.M. until 2:00 P.M. and subject to times established by management of the building. All purchases must be removed via the designated freight elevator. The Auctioneer reserves the right to coordinate times for dismantling and removal of assets.

10. DIRECTIONS TO AUCTION SITE:
From I-95: Exit at Broward Boulevard (Downtown) and continue east to Andrews Avenue. At traffic light turn left and continue to NE 1 Street and turn right. The entrance to the auction site is at the corner of NE 1 Street and NE 3 Avenue. Metered public parking is available at the lot directly west of the auction site location.
From Florida's Turnpike Exit at I-595 and continue east to I-95 North. Continue to Broward Boulevard (Downtown) and exit in eastbound direction. Continue east on Broward Boulevard to Andrews Avenue and turn left at the traffic signal. Continue on Andrews Avenue to NE 1 Street and turn right. The entrance to the auction site is at the corner of NE 1 Street and NE 3 Avenue. Metered public parking is available at the lot directly west of the auction site location.
